1. Acceptance of Terms
By creating an account or using BuildTracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
BuildTracker is a cloud-based construction project management platform that allows users to manage projects, clients, quotes, invoices, budgets, tasks, and team members. The Service is provided on a subscription basis with a free tier and paid plans.
3. Account Registration
To use the Service you must:
- Provide a valid email address and create a secure password
- Be at least 18 years of age
- Provide accurate and complete information
- Keep your login credentials confidential
You are responsible for all activity that occurs under your account.
4. Subscription Plans and Payment
BuildTracker offers the following plans:
- Free — limited to 3 projects and 10 clients, no charge
- Pro — $19.00 USD per month, up to 25 projects, unlimited clients
- Business — $79.00 USD per month, unlimited projects and clients
Paid subscriptions are billed monthly in advance. All prices are in US dollars. Payments are processed securely by our payment provider. By subscribing to a paid plan you authorise us to charge your payment method on a recurring monthly basis.
5. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date.
All purchases are eligible for a full refund within 14 days of the transaction date, no questions asked. To request a refund, contact us at support@buildtracker.tech within 14 days of your purchase. Refunds are processed by Paddle, our payment provider, and may take 5–10 business days to appear.
6. Free Plan Limits
The Free plan is subject to usage limits as described on the Pricing page. We reserve the right to modify free plan limits at any time with reasonable notice.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Upload malicious code, viruses, or harmful content
- Resell or sublicense access to the Service without permission
- Use automated tools to scrape or overload the Service
8. Your Data
You retain ownership of all data you enter into BuildTracker. By using the Service, you grant us a limited licence to store and process your data solely to provide the Service. We will not sell your data to third parties.
We take reasonable technical measures to protect your data, including encrypted connections and row-level database security. However, no system is completely secure and we cannot guarantee absolute security.
9. Data Retention and Deletion
If you close your account, your data will be deleted within 30 days. You may export your data at any time while your account is active. We may retain anonymised, aggregated data for analytics purposes.
10. Availability and Uptime
We aim to keep BuildTracker available at all times but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We are not liable for losses caused by downtime.
11. Intellectual Property
BuildTracker and all associated software, design, and content are the property of BuildTracker and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.
12. Limitation of Liability
To the maximum extent permitted by law, BuildTracker shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of profit, or business interruption. Our total liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim.
13. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will meet your specific requirements or that it will be error-free.
14. Changes to These Terms
We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or by displaying a notice in the app. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
